Atualmente, apenas as empresas que tenham mais de 100 empregados est\u00e3o  sujeitas a cotas para pessoas com defici\u00eancia, como determina a Lei <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/L8213cons.htm\" target=\"_blank\" rel=\"noopener\">8.213\/91<\/a>.<\/p>\n<p>O texto aprovado pela comiss\u00e3o \u00e9 o substitutivo da deputada Elcione  Barbalho (PMDB-PA) ao Projeto de Lei 2967\/00, do Senado. De acordo com o  substitutivo, a empresa dever\u00e1 comprovar o cumprimento da cota para  poder contratar com o Poder P\u00fablico ou receber benef\u00edcios e incentivos  fiscais ou credit\u00edcios.<\/p>\n<p>Essa regra valer\u00e1 as empresas de 50 a 100 empregados e para as demais  empresas que atualmente j\u00e1 precisam cumprir as cotas \u2013 empresas entre  100 e 200 empregados (cota de 2%), de 201 a 500 empregados (cota de 3%),  de 501 a 1 mil empregados (cota de 4%) e com mais de 1 mil empregados  (cota de 5%).<\/p>\n<p>O substitutivo tamb\u00e9m permite que as empresas deduzam da al\u00edquota de  contribui\u00e7\u00e3o patronal para a Previd\u00eancia Social o valor integral das  despesas com a forma\u00e7\u00e3o profissional de pessoas com defici\u00eancia.<\/p>\n<p>Ainda segundo o texto aprovado, a contrata\u00e7\u00e3o de pessoa com  defici\u00eancia dever\u00e1 ser feita de forma direta ou por interm\u00e9dio de  entidade de assist\u00eancia social.<\/p>\n<p><strong>Multas<\/strong><br \/>\nO substitutivo destina ao Fundo de Defesa dos Direitos Difusos o valor  arrecadado com as multas e indeniza\u00e7\u00f5es decorrentes do descumprimento da  cota. Esse fundo est\u00e1 previsto na Lei <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/L7347orig.htm\" target=\"_blank\" rel=\"noopener\">7.347\/85<\/a>. A exce\u00e7\u00e3o \u00e9 para as multas ou indeniza\u00e7\u00f5es destinadas \u00e0 repara\u00e7\u00e3o de danos a interesses individuais da pessoa com defici\u00eancia.<\/p>\n<p>Ao elaborar seu substitutivo, a deputada Elcione Barbalho ampliou as  medidas previstas no texto original do projeto, que tratava apenas de  puni\u00e7\u00e3o \u00e0s empresas. \u201cO cumprimento dessa cota n\u00e3o deve ser visto como  um \u00f4nus para a empresa. Se existe a previs\u00e3o de contrata\u00e7\u00e3o de pessoas  com defici\u00eancia para a esfera p\u00fablica, via concursos p\u00fablicos, tem de  haver a mesma previs\u00e3o para a esfera privada, em respeito ao princ\u00edpio  da igualdade.\u201d<\/p>\n<p>A cota para pessoas com defici\u00eancia no servi\u00e7o p\u00fablico est\u00e1 prevista na Lei <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/L8112cons.htm\" target=\"_blank\" rel=\"noopener\">8.112\/90<\/a> (reserva de at\u00e9 20% das vagas oferecidas em concursos p\u00fablicos).<\/p>\n<p>Elcione Barbalho defendeu a ado\u00e7\u00e3o de medidas de discrimina\u00e7\u00e3o  positiva direcionadas \u00e0s pessoas com defici\u00eancia, para que seus direitos  de cidadania sejam efetivados em sua plenitude. \u201cN\u00e3o se pode esquecer  que esse grupo social tem sido historicamente alijado do exerc\u00edcio de  direitos sociais mais b\u00e1sicos, como o direito ao trabalho, em face do  preconceito enraizado na sociedade brasileira\u201d, disse.<\/p>\n<p><strong>Tramita\u00e7\u00e3o<\/strong><br \/>\nA proposta tramita em car\u00e1ter conclusivo e
