A Proposta de Emenda Constitucional\u00a0171\/1993<\/span><\/a>, que reduz a maioridade penal de 18 para 16 anos, foi denunciada (25\/6) por tr\u00eas redes de direitos humanos brasileiras na\u00a029\u00aa Sess\u00e3o do Conselho de Direitos Humanos da ONU<\/span><\/a>.<\/p>\n

No\u00a0pronunciamento oral<\/span><\/a>,\u00a0Rede de Justi\u00e7a Criminal<\/span><\/a>, da qual a Conectas faz parte,\u00a0Renade<\/span><\/a>\u00a0(Rede Nacional de Defesa do Adolescente em Conflito com a Lei) e\u00a0Anced<\/span><\/a>\u00a0(Associa\u00e7\u00e3o Nacional dos Centros de Defesa da Crian\u00e7a e do Adolescente) ressaltaram que a proposta representa um \u201cgrave retrocesso\u201d para o Pa\u00eds e\u00a0criminaliza um \u201cdos segmentos mais vulner\u00e1veis\u201d da sociedade brasileira.<\/p>\n

\u201cNum pa\u00eds com hist\u00f3rica desigualdade social e priva\u00e7\u00e3o de direitos, essas propostas aprofundar\u00e3o o grau de viola\u00e7\u00f5es de direitos j\u00e1 existente\u201d,\u00a0afirmou Paulo Lugon, representante das entidades em Genebra.<\/p>\n

No dia 17\/6, uma Comiss\u00e3o Especial da C\u00e2mara dos Deputados aprovou a texto, que deve ser votado nos pr\u00f3ximos dias pelo plen\u00e1rio da Casa. Se aprovado em dois turnos por qu\u00f3rum qualificado (superior a 60%), a proposta segue para tramita\u00e7\u00e3o no Senado.<\/p>\n

No pronunciamento, as organiza\u00e7\u00f5es refor\u00e7aram a inconsist\u00eancia da medida com normas e recomenda\u00e7\u00f5es internacionais. \u201cUma eventual reforma da idade penal iria contrariar recomenda\u00e7\u00e3o da pr\u00f3pria ONU, que v\u00ea na medida uma amea\u00e7a para os direitos das crian\u00e7as e adolescentes e contraria tend\u00eancias mundiais na gest\u00e3o da justi\u00e7a juvenil\u201d, afirmaram as entidades.<\/p>\n

Elas pedem, ainda, que o Conselho e o Alto Comissariado da ONU para os Direitos Humanos se manifestem contra a medida e que seus Estados-membros incluam o tema em suas comunica\u00e7\u00f5es com o Brasil.<\/p>\n

Ainda no \u00e2mbito das Na\u00e7\u00f5es Unidas, uma\u00a0carta<\/span><\/a>\u00a0assinada por 92 entidades brasileiras foi entregue \u00e0s 150 delega\u00e7\u00f5es dos pa\u00edses e observadores que integram o Conselho. O texto pede que eles mencionem, em seus pronunciamentos durante a sess\u00e3o, o risco de o Brasil cometer um retrocesso no campo dos direitos da crian\u00e7a e do adolescente.<\/p>\n

De\u00a054 pa\u00edses estudados<\/a>\u00a0pela Unicef (Fundo das Na\u00e7\u00f5es Unidas para a Inf\u00e2ncia), 78% fixam a idade penal em 18 anos ou mais. Entre eles est\u00e3o Fran\u00e7a, Espanha, Su\u00ed\u00e7a, Noruega e Uruguai.<\/p>\n

Mr President<\/p>\n

Conectas Human Rights, in partnership with the Criminal Justice Network, RENADE and the Brazil Chapter of\u00a0 the Defense for Children International \u2013 ANCED, calls the attention of\u00a0 this Council, the member States and the entire international community to the serious setback that Brazil is about to commit<\/p>\n

There\u00a0 is a constitutional\u00a0\u00a0 amendment currently\u00a0 pending\u00a0 before\u00a0 Brazil\u2019s House of\u00a0 Representatives that, if\u00a0 approved, will allow adolescents between the ages of\u00a0 16 and 18 to be punished as adults.<\/p>\n

Within the current system, adolescents between the ages of\u00a0 12 and 18\u00a0 are already held\u00a0 accountable by\u00a0 the juvenile justice\u00a0 system,\u00a0 which\u00a0 includes deprivation of\u00a0 liberty.<\/p>\n

Your Excellencies,<\/p>\n

Such Constitutional\u00a0 reform would \u00a0be Instrument al\u00a0 in criminalizing the\u00a0 most\u00a0 vulnerable Groups of\u00a0 Brazilian society: poor youth. In a country with a historical of\u00a0 social inequality, these proposals will only serve to increase the existing degree of\u00a0 violations.<\/p>\n

Moreover, it is inflammatory, given that it is estimated that of\u00a0 the nearly 60,000 homicides in Brazil in 2012 only 4% were committed by persons below the age of\u00a0 18. On the other hand, more than half\u00a0 of\u00a0 those killed were young people between the ages of\u00a0 15 and 29, of\u00a0 which\u00a0 77%\u00a0 were\u00a0 black.\u00a0 In\u00a0 other\u00a0 words\u00a0 young\u00a0 Brazilians\u00a0 are the victims,\u00a0 not the perpetrators of\u00a0 violence.<\/p>\n

Lowering the age of\u00a0 criminal responsibility threats the rights of\u00a0 people under 18, as it was indicated by the UN itself, It also contradicts global trends in the management of\u00a0 juvenile justice.\u00a0 The\u00a0 UMODC and\u00a0 UNICEF have also reiterated\u00a0 the\u00a0 importance\u00a0 of\u00a0\u00a0 the Convention on the Rights of\u00a0 the Child and are against this reduction.<\/p>\n

We urge this Council to condemn this reform, call on the High Commissioner to act in order\u00a0 to\u00a0 prevent\u00a0 this\u00a0 immeasurable\u00a0 set back and\u00a0 ask member\u00a0 States\u00a0 and\u00a0 observers to include the issue in their communications to Brazil.<\/p>\n
