Introdu\u00e7\u00e3o<br \/>\n1. O Comit\u00ea considerou o relat\u00f3rio inicial do Brasil (CDPD \/ C \/ BRA \/ 1) Nas suas reuni\u00f5es 216th e 217th, realizadas em 25 e 26 de Agosto de 2015, respectivamente, e aprovou as seguintes observa\u00e7\u00f5es finais em sua reuni\u00e3o realizada em 226, 1 setembro 2015.<br \/>\n2. O Comit\u00ea congratula o relat\u00f3rio inicial do Brasil, que foi preparado de acordo com as diretrizes para relat\u00f3rios do Comit\u00ea, e agradece ao Estado Parte pelas respostas por escrito (CDPD \/ C \/ BRA \/ CO \/ R.1) para a lista de quest\u00f5es preparadas pelo Comit\u00ea.<br \/>\n3. O Comit\u00e9 aprecia o di\u00e1logo frut\u00edfero mantido com a delega\u00e7\u00e3o do Estado-parte e recomenda ao Estado pelo alto n\u00edvel da sua delega\u00e7\u00e3o, que incluiu um n\u00famero not\u00e1vel de delegados com defici\u00eancia de todos os tr\u00eas ramos do governo do Estado.<\/p>\n<p>II. Aspectos positivos<br \/>\n4. O Comit\u00ea parabeniza o Estado por\u00a0 uma s\u00e9rie de realiza\u00e7\u00f5es, notadamente, que a Conven\u00e7\u00e3o tenha equival\u00eancia normativa Constitucional, a cria\u00e7\u00e3o de uma Comiss\u00e3o Permanente sobre os Direitos das Pessoas com Defici\u00eancia na C\u00e2mara dos Deputados do Congresso Nacional, em 2015, e a ado\u00e7\u00e3o de um Plano Nacional dos Direitos das Pessoas com Defici\u00eancia &#8211; Viver Sem Limites. Congratula pela cria\u00e7\u00e3o de conselhos sobre os direitos das pessoas com defici\u00eancia nos n\u00edveis municipais e estaduais, bem como no Distrito Federal, a ado\u00e7\u00e3o de v\u00e1rias medidas para melhorar a acessibilidade em diferentes \u00e1reas da Conven\u00e7\u00e3o, tais como a campanha BB de acessibilidade para facilitar acesso a tecnologias assistivas, a cria\u00e7\u00e3o do Comit\u00e9 Ministerial de Assist\u00eancia T\u00e9cnica, e as disposi\u00e7\u00f5es jur\u00eddicas para implementar a acessibilidade nos sites governamentais, r\u00e1dio e TV, e a provis\u00e3o de presta\u00e7\u00f5es pecuni\u00e1rias a pessoas com defici\u00eancia, pelo Sistema de Seguran\u00e7a Social.<br \/>\n5. O Comit\u00ea tamb\u00e9m recomenda o Estado por sem membro do Grupo de Washington sobre Estat\u00edstica em defici\u00eancia , e sua agenda de coopera\u00e7\u00e3o internacional para melhorar o exerc\u00edcio dos direitos das pessoas com defici\u00eancia em pa\u00edses de l\u00edngua portuguesa.<\/p>\n<p>III. Principais \u00e1reas de preocupa\u00e7\u00e3o e recomenda\u00e7\u00f5es<\/p>\n<p>A. Princ\u00edpios Gerais e obriga\u00e7\u00f5es (arts. 04\/01)<br \/>\n6. O Comit\u00ea est\u00e1 preocupado com a falta de uma estrat\u00e9gia coerente e global voltada para a defici\u00eancia, para implementar o modelo de direitos humanos da defici\u00eancia estabelecido na Conven\u00e7\u00e3o e harmonizar a legisla\u00e7\u00e3o, pol\u00edticas e programas do Estado Parte.<br \/>\n7. O Comit\u00ea recomenda que o Estado-parte desenvolva uma estrat\u00e9gia voltada para a defici\u00eancia para implementar o modelo de direitos humanos de defici\u00eancia. O Comit\u00ea recomenda ainda que, em consulta com as organiza\u00e7\u00f5es de pessoas com defici\u00eancia, o Estado Parte inicie uma revis\u00e3o sistem\u00e1tica da legisla\u00e7\u00e3o, pol\u00edticas e programas existentes e, se necess\u00e1rio, ajuste-os de acordo com a Conven\u00e7\u00e3o. Isto deve incluir uma revis\u00e3o de toda a legisla\u00e7\u00e3o, pol\u00edticas ou programas em que os direitos das pessoas com defici\u00eancia sejam limitados ou negados com base na defici\u00eancia, ou onde os servi\u00e7os ou benef\u00edcios para as pessoas com defici\u00eancia levem \u00e0 sua segrega\u00e7\u00e3o ou exclus\u00e3o.<br \/>\n8. O Comit\u00ea est\u00e1 preocupado que o Estatuto das Pessoas com Defici\u00eancia (Lei Brasileira de Inclus\u00e3o da Pessoa com Defici\u00eancia) n\u00e3o cumpra todas as obriga\u00e7\u00f5es do Estado Parte \u00e0 luz da Conven\u00e7\u00e3o.<br \/>\n9. A Comiss\u00e3o insta o Estado a tomar medidas imediatas para trazer o Estatuto das Pessoas com Defici\u00eancia (Lei Brasileira de Inclus\u00e3o da Pessoa com Defici\u00eancia) em pleno alinhamento com a Conven\u00e7\u00e3o antes de sua entrada em vigor, em consulta com as organiza\u00e7\u00f5es de pessoas com defici\u00eancia .<br \/>\n10. O Comit\u00ea est\u00e1 preocupado com a falta de mecanismos em vigor para a participa\u00e7\u00e3o das pessoas com defici\u00eancia, atrav\u00e9s das suas organiza\u00e7\u00f5es representativas, nos processos de tomada de decis\u00f5es relativas \u00e0 implementa\u00e7\u00e3o da Conven\u00e7\u00e3o.<br \/>\n11. O Comit\u00ea recomenda a ado\u00e7\u00e3o de um mecanismo de consulta para consultas sistem\u00e1ticas com pessoas com defici\u00eancia, atrav\u00e9s das suas organiza\u00e7\u00f5es representativas, sobre as pol\u00edticas, programas e legisla\u00e7\u00e3o relativas \u00e0 implementa\u00e7\u00e3o da Conven\u00e7\u00e3o. O Comit\u00ea tamb\u00e9m recomenda que o Estado-Parte implemente rapidamente os resultados de todas as confer\u00eancias nacionais sobre os direitos das pessoas com defici\u00eancia, incluindo as propostas da &#8220;III Confer\u00eancia Nacional sobre os Direitos das Pessoas com Defici\u00eancia&#8221; (CDPD \/ C \/ BRA \/ Q \/ 1 \/ Add.1 para. 11).<\/p>\n<p>B. Direitos Espec\u00edficos (arts. 5-30)<\/p>\n<p>Igualdade e n\u00e3o discrimina\u00e7\u00e3o (art. 5)<br \/>\n12. O Comit\u00ea est\u00e1 preocupado com a falta de medidas para enfrentar a discrimina\u00e7\u00e3o contra as pessoas ind\u00edgenas e afro-descendentes com defici\u00eancia. Em particular, est\u00e1 preocupado com o isolamento das comunidades ind\u00edgenas que colocam as pessoas com defici\u00eancia em condi\u00e7\u00f5es de exclus\u00e3o extremas.<br \/>\n13. O Comit\u00ea recomenda ao Estado Parte aplicar a legisla\u00e7\u00e3o, pol\u00edticas e programas inter-setoriais para lidar com as m\u00faltiplas formas de discrimina\u00e7\u00e3o contra as pessoas ind\u00edgenas e afro-descendentes com defici\u00eancia, em particular, para evitar que as pessoas com defici\u00eancia que vivem em comunidades ind\u00edgenas isoladas, ou em \u00e1reas remotas, de exclus\u00e3o.<\/p>\n<p>Mulheres com defici\u00eancia (art. 6)<br \/>\n14. O Comit\u00ea est\u00e1 preocupado que as medidas tomadas pelo Estado-parte para prevenir a viol\u00eancia contra mulheres e meninas, como a Lei Maria da Penha (Lei n\u00ba 11340\/2006) e Hotline Atendimento \u00e0 Mulher &#8211; Ligue 180, n\u00e3o sejam eficazes no combate \u00e0 viol\u00eancia contra as mulheres e meninas com defici\u00eancia, e n\u00e3o sejam totalmente acess\u00edveis a surdos e outras mulheres e meninas com defici\u00eancia.<br \/>\n15. O Comit\u00ea recomenda o Estado-Parte a tomar medidas imediatas a adotar medidas concretas para garantir que suas leis, pol\u00edticas e programas especificamente destinados \u00e0 viol\u00eancia contra as mulheres, incluindo as mulheres institucionalizadas, sejam acess\u00edveis e eficazes na preven\u00e7\u00e3o e repara\u00e7\u00e3o da viol\u00eancia contra as mulheres e meninas com defici\u00eancia, incluindo medidas espec\u00edficas, metas e indicadores.<br \/>\n16. O Comit\u00ea tamb\u00e9m est\u00e1 preocupado que o Estado n\u00e3o tenha uma estrat\u00e9gia para assegurar o pleno desenvolvimento, o avan\u00e7o eo empoderamento das mulheres com defici\u00eancia, em conformidade com o artigo 6, par\u00e1grafo 2, da Conven\u00e7\u00e3o.<br \/>\n17. O Comit\u00ea recomenda que, em consulta com as mulheres com defici\u00eancia e suas organiza\u00e7\u00f5es representativas, o Estado Parte implemente uma estrat\u00e9gia para promover cada um dos tr\u00eas elementos do artigo 6, par\u00e1grafo 2, da Conven\u00e7\u00e3o.<\/p>\n<p>Crian\u00e7as com defici\u00eancia (art. 7)<br \/>\n18. O Comit\u00ea est\u00e1 preocupado que as crian\u00e7as com defici\u00eancia n\u00e3o sejam sistematicamente envolvidas nas decis\u00f5es que afetam suas vidas e n\u00e3o tenham a oportunidade de expressar sua opini\u00e3o em assuntos que as afetam diretamente.<br \/>\n19. O Comit\u00ea recomenda que o Estado Parte adote salvaguardas para garantir a consulta de meninas e meninos com defici\u00eancia e suas organiza\u00e7\u00f5es representativas em todas as decis\u00f5es que afetam suas vidas.<\/p>\n<p>Sensibiliza\u00e7\u00e3o (art. 8)<br \/>\n20. O Comit\u00ea est\u00e1 preocupado com a falta de estrat\u00e9gias para promover especificamente o conte\u00fado da Conven\u00e7\u00e3o e do modelo de direitos humanos de incapacidade para o p\u00fablico em geral, funcion\u00e1rios p\u00fablicos e agentes privados.<br \/>\n21. O Comit\u00ea recomenda que o Estado Parte, em coopera\u00e7\u00e3o com organiza\u00e7\u00f5es de pessoas com defici\u00eancia, realize campanhas de sensibiliza\u00e7\u00e3o do p\u00fablico para refor\u00e7ar a imagem positiva das pessoas com defici\u00eancia como detentores de todos os direitos humanos consagrados na Conven\u00e7\u00e3o. O Comit\u00ea tamb\u00e9m recomenda que o Estado-parte ofere\u00e7a forma\u00e7\u00e3o sobre os direitos reconhecidos na Conven\u00e7\u00e3o a todas as autoridades p\u00fablicas e profissionais p\u00fablicos e privados que trabalham com pessoas com defici\u00eancia. Recomenda igualmente fornecer informa\u00e7\u00f5es sobre a Conven\u00e7\u00e3o para pessoas com defici\u00eancia, em especial ind\u00edgenas com defici\u00eancia e suas fam\u00edlias.<\/p>\n<p>Acessibilidade (artigo 9.\u00ba)<br \/>\n22. O Comit\u00ea observa com preocupa\u00e7\u00e3o que a acessibilidade do ambiente constru\u00eddo, transportes, informa\u00e7\u00e3o e comunica\u00e7\u00e3o e servi\u00e7os abertos ao p\u00fablico n\u00e3o esteja plenamente alcan\u00e7ada, especialmente em \u00e1reas remotas e rurais.<br \/>\n23. O Comit\u00ea recomenda que o Estado-Parte tome medidas eficazes para garantir a acessibilidade do ambiente constru\u00eddo, transportes, informa\u00e7\u00e3o e comunica\u00e7\u00e3o e servi\u00e7os abertos ao p\u00fablico, em linha com a do Comit\u00ea Coment\u00e1rio Geral n.\u00ba 2 (2014), na acessibilidade, na \u00e1reas rurais e remotas, inclusive com a plena implementa\u00e7\u00e3o da legisla\u00e7\u00e3o em vigor, incluindo os contratos p\u00fablicos e as pol\u00edticas, um acompanhamento eficaz e puna todos os que n\u00e3o cumprirem integralmente as normas de acessibilidade.<br \/>\nIgual Reconhecimento perante a lei (artigo 12.\u00ba).<br \/>\n24. O Comit\u00ea est\u00e1 preocupado que a legisla\u00e7\u00e3o do Estado-parte ainda preveja\u00a0 a tomada substitutiva de decis\u00e3o em algumas circunst\u00e2ncias. Isto \u00e9 contr\u00e1rio ao artigo 12 da Conven\u00e7\u00e3o, como o Comit\u00e9 explica no coment\u00e1rio geral No. 1 (2014) sobre a igualdade e reconhecimento perante a lei. O Comit\u00ea tamb\u00e9m est\u00e1 preocupado que os processos decis\u00f3rios apoiados exijam a aprova\u00e7\u00e3o judicial e n\u00e3o d\u00eaem primazia \u00e0 autonomia, vontade e \u00e0s prefer\u00eancias das pessoas com defici\u00eancia.<br \/>\n25. A Comiss\u00e3o insta o Estado a retirar todas as disposi\u00e7\u00f5es legais que perpetuam o sistema de tomada de decis\u00e3o substitutiva. Ele tamb\u00e9m recomenda que, em consulta com as organiza\u00e7\u00f5es de pessoas com defici\u00eancia e outros prestadores de servi\u00e7os, o Estado Parte adote medidas concretas para substituir o sistema de substitutivo com um modelo de tomada de decis\u00e3o apoiada, que defenda a autonomia, a vontade e as prefer\u00eancias na tomada de decis\u00e3o das pessoas com defici\u00eancia, em plena conformidade com o artigo 12 da Conven\u00e7\u00e3o. Recomenda ainda que todas as pessoas com defici\u00eancia atualmente sob tutela sejam devidamente informadas sobre o novo regime legal e que o exerc\u00edcio do direito \u00e0 tomada de decis\u00e3o apoiada deve ser garantido em todos os casos.<\/p>\n<p>Acesso \u00e0 justi\u00e7a (art. 13)<br \/>\n26. O Comit\u00ea est\u00e1 preocupado com a falta de acessibilidade das instala\u00e7\u00f5es judiciais. Ele tamb\u00e9m est\u00e1 preocupado com a falta de medidas para assegurar acomoda\u00e7\u00f5es adequadas ao g\u00eanero e \u00e0 idade em processos relacionados com pessoas com defici\u00eancia.<br \/>\n27. O Comit\u00ea recomenda que o Estado-parte apresente um plano nacional para garantir a acessibilidade das instala\u00e7\u00f5es judiciais. Recomenda tamb\u00e9m que tome medidas para assegurar que os processos judiciais incluam acomoda\u00e7\u00f5es adequadas \u00e0 idade, ao g\u00e9nero e \u00e0s pessoas com defici\u00eancia. Al\u00e9m disso, o Comit\u00ea recomenda a introdu\u00e7\u00e3o de treinamento efetivo de pessoal nos sistemas de justi\u00e7a, policiais e prisionais sobre os direitos consagrados na Conven\u00e7\u00e3o.<\/p>\n<p>Liberdade e seguran\u00e7a da pessoa e proibi\u00e7\u00e3o da tortura ou tratamento ou castigo cruel, desumano ou degradante (arts. 14 e 15)<br \/>\n28. O Comit\u00ea est\u00e1 preocupado com relatos da priva\u00e7\u00e3o arbitr\u00e1ria de liberdade e tratamento involunt\u00e1rio de pessoas com defici\u00eancia, com base em defici\u00eancia, incluindo situa\u00e7\u00f5es em que \u00e9 assumido que as pessoas com defici\u00eancia s\u00e3o perigosas para si ou para outrem, com base em um diagn\u00f3stico discriminat\u00f3rio.<br \/>\n29. O Comit\u00ea recomenda que o Estado-Parte a tomar medidas, incluindo a revoga\u00e7\u00e3o das disposi\u00e7\u00f5es legais pertinentes, para abolir a pr\u00e1tica da interna\u00e7\u00e3o involunt\u00e1ria ou hospitaliza\u00e7\u00e3o tratamento m\u00e9dico for\u00e7ado e que pro\u00edba, em particular tratamentos psiqui\u00e1tricos, com base na defici\u00eancia e forne\u00e7a alternativas de tratanmento baseado na comunidade.<br \/>\n30. O Comit\u00ea est\u00e1 preocupado que as pessoas com defici\u00eancia que n\u00e3o s\u00e3o consideradas respons\u00e1veis \u200b\u200bpela pr\u00e1tica de um crime com base na defici\u00eancia podem estar sujeitos a medidas de seguran\u00e7a, incluindo a deten\u00e7\u00e3o indefinida. O Comit\u00ea tamb\u00e9m est\u00e1 preocupado com deten\u00e7\u00f5es arbitr\u00e1rias que podem escalar para um tratamento desumano e degradante ou tortura. \u00c9 ainda mais preocupante a situa\u00e7\u00e3o das pessoas com defici\u00eancia privadas de sua liberdade em pris\u00f5es e outros locais de deten\u00e7\u00e3o, que s\u00e3o superlotados e onde os maus-tratos ps\u00edquico e psicol\u00f3gico dos detentos se tornam uma norma,\u00a0 sobre tortura e outros tratamentos ou penas cru\u00e9is, desumanas ou degradantes, como afirmou o relator especial da ONU no final de sua visita oficial ao Brasil em agosto de 2015.<br \/>\n31. O Comit\u00ea recomenda que o Estado Parte:<br \/>\n(a) Suprima as medidas de seguran\u00e7a que envolvem a deten\u00e7\u00e3o arbitr\u00e1ria de pessoas com defici\u00eancia com base em defici\u00eancia e implemente medidas alternativas que sejam consistentes com os artigos 14 e 19 da Conven\u00e7\u00e3o; e<br \/>\n(b) Assegure que os estabelecimentos penitenci\u00e1rios s\u00e3o acess\u00edveis e prever adapta\u00e7\u00f5es razo\u00e1veis \u200b\u200bpara as pessoas com defici\u00eancia.<\/p>\n<p>Contra a explora\u00e7\u00e3o, viol\u00eancia e abuso (16 art.)<br \/>\n32. O Comit\u00ea est\u00e1 preocupado com a falta de mecanismos dedicados a identificar, investigar e processar os casos de explora\u00e7\u00e3o, viol\u00eancia e abuso contra pessoas com defici\u00eancia. O Comit\u00e9 lamenta tamb\u00e9m a falta de dados desagregados nos relat\u00f3rios e investiga\u00e7\u00f5es sobre abuso, explora\u00e7\u00e3o e viol\u00eancia contra mulheres, homens, meninas e meninos com defici\u00eancia.<br \/>\n33. O Comit\u00ea recomenda que o Estado-parte assegure a disponibiliza\u00e7\u00e3o de monitoramento acess\u00edvel, eficaz e independente dos programas e instala\u00e7\u00f5es destinados a atender pessoas com defici\u00eancia, e mecanismos de reclama\u00e7\u00e3o em alinhamento com o artigo 16 (3) e assegure que as autoridades possam identificar, investigar e processar todos os casos de viol\u00eancia contra pessoas com defici\u00eancia. Recomenda tamb\u00e9m garantir que o Minist\u00e9rio P\u00fablico e os escrit\u00f3rios de advogados para pessoas com defici\u00eancia investiguem os casos relacionados \u00e0 viol\u00eancia e \u00e0 explora\u00e7\u00e3o das pessoas com defici\u00eancia atrav\u00e9s da atribui\u00e7\u00e3o de recursos humanos, t\u00e9cnicos e financeiros. O Comit\u00ea recomenda que o Estado Parte colete dados desagregados e estat\u00edsticas sobre relat\u00f3rios de pessoas com defici\u00eancia sobre abuso, explora\u00e7\u00e3o e viol\u00eancia, e os seus resultados.<\/p>\n<p>Proteger a integridade da pessoa (art. 17)<br \/>\n34. O Comit\u00ea est\u00e1 profundamente preocupado que as crian\u00e7as e adultos com defici\u00eancia, cuja capacidade legal \u00e9 restriao atrav\u00e9s de interdi\u00e7\u00e3o possa ser esterilizado sem o seu consentimento livre e esclarecido, de acordo com a Lei n\u00ba 9263\/1996. Ele tamb\u00e9m est\u00e1 preocupado que o Estatuto das Pessoas com Defici\u00eancia (Lei Brasileira de Inclus\u00e3o da Pessoa com Defici\u00eancia), autoriza o tratamento cir\u00fargico sobre pessoas com defici\u00eancia sob curatela, na aus\u00eancia de consentimento livre, pr\u00e9vio e informado sobre uma base desigual com os outros.<br \/>\n35. O Comit\u00e9 recomenda ao Estado Parte tomar medidas para:<br \/>\n(a) rever imediatamente a Lei n\u00ba 9263\/1996 e explicitamente proibir incondicionalmente a esteriliza\u00e7\u00e3o de pessoas com defici\u00eancia, na aus\u00eancia de seu consentimento pr\u00e9vio, livre e plenamente informado e individual;<br \/>\n(b) assegurar que as pessoas com defici\u00eancia recebam apoio para fazer escolhas informadas e decis\u00f5es relativas a procedimentos m\u00e9dicos e interven\u00e7\u00f5es; e<br \/>\ncampanhas (c) de conduta para sensibilizar as fam\u00edlias, tutores, profissionais m\u00e9dicos e gestores de institui\u00e7\u00f5es de direitos das pessoas com defici\u00eancia, em especial as mulheres e meninas com defici\u00eancia, nos termos do artigo 17 da Conven\u00e7\u00e3o.<\/p>\n<p>Vida independente e inclus\u00e3o na comunidade (art. 19)<br \/>\n36. O Comit\u00ea est\u00e1 preocupado com a falta de acesso a servi\u00e7os de apoio e subs\u00eddios, em especial os servi\u00e7os de assist\u00eancia pessoal, que visam possibilitar \u00e0s pessoas com defici\u00eancia viver de forma independente e ser inclu\u00eddas na comunidade. O Comit\u00ea tamb\u00e9m est\u00e1 preocupado que o Estado n\u00e3o tenha uma estrat\u00e9gia global para substituir a institucionaliza\u00e7\u00e3o com a vida baseada na comunidade para pessoas com defici\u00eancia.<br \/>\n37. O Comit\u00ea recomenda ao Estado Parte que estabele\u00e7a um quadro legal que preveja o direito a servi\u00e7os de assist\u00eancia pessoal para permitir \u00e0s pessoas com defici\u00eancia viveren de forma independente na comunidade. O Comit\u00ea recomenda ainda que, em consulta com as organiza\u00e7\u00f5es de pessoas com defici\u00eancia, o Estado Parte desenvolva e implemente uma desinstitucionaliza\u00e7\u00e3o eficaz e uma estrat\u00e9gia de vida baseada na comunidade com prazos e objetivos claros.<\/p>\n<p>Liberdade de express\u00e3o e de opini\u00e3o e acesso \u00e0 informa\u00e7\u00e3o (21 art.)<br \/>\n38. O Comit\u00ea est\u00e1 preocupado que a informa\u00e7\u00e3o destinada ao p\u00fablico em geral, incluindo os pronunciamentos oficiais e campanhas pol\u00edticas, ainda n\u00e3o estejam totalmente dispon\u00edveis em formatos acess\u00edveis, como Braille, l\u00edngua brasileira de sinais (LIBRAS), e outros modos acess\u00edveis, nos meios e as formas de comunica\u00e7\u00e3o, incluindo formato f\u00e1cil de ler.<br \/>\n39. O Comit\u00ea recomenda que o Estado-parte forne\u00e7a os recursos e forma\u00e7\u00e3o necess\u00e1rios para garantir que todas as informa\u00e7\u00f5es destinadas ao p\u00fablico em geral esteja dispon\u00edvel em tempo h\u00e1bil em formatos e tecnologias acess\u00edveis.<\/p>\n<p>Respeito ao lar e vida familiar (art. 23)<br \/>\n40. O Comit\u00ea est\u00e1 preocupado que as pessoas com defici\u00eancia sejam separadas de seus filhos com base na defici\u00eancia.<br \/>\n41. O Comit\u00ea recomenda que o Estado Parte tome medidas legais para proibir explicitamente a retirada de crian\u00e7as com base no comprometimento de seus pais, incluindo quando o pai esteja sujeito \u00e0 interdi\u00e7\u00e3o.<br \/>\n42. O Comit\u00ea est\u00e1 preocupado com a falta de dados desagregados sobre o n\u00famero de fam\u00edlias de crian\u00e7as com defici\u00eancia que t\u00eam acesso a bases de apoio, tais como os Centros de Refer\u00eancia Especializados de Assist\u00eancia Social (Centro de Refer\u00eancia Especializado da Assist\u00eancia social &#8211; CREAS).<br \/>\n43. O Comit\u00ea recomenda que o Estado Parte colete e reporte dados desagregados sobre a disponibilidade de bases de apoio para as fam\u00edlias das crian\u00e7as com defici\u00eancia, e o n\u00famero de fam\u00edlias que acessem esses servi\u00e7os.<\/p>\n<p>Educa\u00e7\u00e3o (art. 24)<br \/>\n44. O Comit\u00ea est\u00e1 preocupado que a matr\u00edcula de crian\u00e7as com defici\u00eancia seja recusada em escolas, ou sejam cobradas taxas extras. Al\u00e9m disso, o Comit\u00ea est\u00e1 preocupado com a falta de acomoda\u00e7\u00e3o razo\u00e1vel e ambientes escolares acess\u00edveis\u00a0 \u200b\u200bno sistema de ensino regular.<br \/>\n45. O Comit\u00ea recomenda que o Estado Parte intensifique os seus esfor\u00e7os com dota\u00e7\u00f5es or\u00e7ament\u00e1rias adequadas para consolidar um sistema de educa\u00e7\u00e3o inclusiva de qualidade. Ele tamb\u00e9m recomenda a implementa\u00e7\u00e3o de um mecanismo para proibir, fiscalizar e sancionar a discrimina\u00e7\u00e3o com base na defici\u00eancia nos sistemas de ensino p\u00fablico e privado, e de prever adapta\u00e7\u00f5es razo\u00e1veis \u200b\u200be acessibilidade em todas as instala\u00e7\u00f5es educacionais.<\/p>\n<p>Sa\u00fade (art. 25)<br \/>\n46. \u200b\u200bO Comit\u00ea est\u00e1 preocupado que os servi\u00e7os de sa\u00fade convencionais n\u00e3o sejam acess\u00edveis para pessoas com defici\u00eancia. O Comit\u00ea tamb\u00e9m est\u00e1 preocupado com a falta de profissionais de sa\u00fade que t\u00eam a forma\u00e7\u00e3o adequada para prestar cuidados de sa\u00fade inclusivo e atender \u00e0s necessidades espec\u00edficas das pessoas com defici\u00eancia.<br \/>\n47. O Comit\u00ea recomenda que o Estado Parte adote planos e aloque recursos para garantir que os servi\u00e7os tradicionais de sa\u00fade, incluindo os servi\u00e7os de sa\u00fade sexual e reprodutiva e informa\u00e7\u00f5es, sejam acess\u00edveis a pessoas com defici\u00eancia. Ele tamb\u00e9m recomenda que o Estado Parte garanta que os profissionais de sa\u00fade nos servi\u00e7os de sa\u00fade tradicionais recebam forma\u00e7\u00e3o sobre os direitos consagrados na Conven\u00e7\u00e3o.<\/p>\n<p>Trabalho e emprego (art. 27)<br \/>\n48. O Comit\u00ea est\u00e1 preocupado com a discrimina\u00e7\u00e3o contra pessoas com defici\u00eancia no mundo do trabalho, especialmente as mulheres com defici\u00eancia, e que continuem dependentes de de oficinas protegidas. Ele tamb\u00e9m est\u00e1 preocupado com os baixos n\u00edveis de conformidade com o regime de quotas aplic\u00e1vel \u00e0s empresas privadas com 100 ou mais empregados.<br \/>\n49. O Comit\u00ea recomenda que, em consulta com as organiza\u00e7\u00f5es que representam pessoas com defici\u00eancia, o Estado Parte desenvolva e implemente uma estrat\u00e9gia coordenada para aumentar o emprego das pessoas com defici\u00eancia no mercado de trabalho aberto, incluindo medidas espec\u00edficas para as mulheres com defici\u00eancia. Recomenda-se ainda tomar medidas imediatas para criar possibilidades de transi\u00e7\u00e3o do emprego segregado para o mercado de trabalho aberto.<\/p>\n<p>Padr\u00e3o adequado de vida e prote\u00e7\u00e3o social (28 art.)<br \/>\n50. O Comit\u00ea est\u00e1 preocupado que muitas pessoas com defici\u00eancia vivam em situa\u00e7\u00e3o de pobreza e n\u00e3o t\u00eam acesso a recursos para manter um padr\u00e3o de vida adequado; est\u00e1 particularmente preocupado com as pessoas com defici\u00eancia que vivem em comunidades ind\u00edgenas isoladas, \u00e1reas rurais remotas e em condi\u00e7\u00f5es de extrema pobreza, que est\u00e3o expostas \u00e0 exclus\u00e3o.<br \/>\n51. O Comit\u00ea recomenda que o Estado Parte reveja os requisitos de qualifica\u00e7\u00e3o para a prote\u00e7\u00e3o social para garantir o acesso \u00e0s pessoas com defici\u00eancia que vivem em situa\u00e7\u00e3o de pobreza e capacit\u00e1-los a cobrir as despesas relacionadas com a defici\u00eancia, dando especial aten\u00e7\u00e3o \u00e0s que vivem em comunidades ind\u00edgenas isoladas, rural e \u00e1reas remotas. Participa\u00e7\u00e3o na vida pol\u00edtica e p\u00fablica (art. 29)<br \/>\n52. O Comit\u00ea est\u00e1 preocupado que as pessoas com defici\u00eancia sob interdi\u00e7\u00e3o sejam discriminadas em rela\u00e7\u00e3o a seu direito de voto. O Comit\u00ea tamb\u00e9m est\u00e1 preocupado que muitos locais de vota\u00e7\u00e3o n\u00e3o s\u00e3o acess\u00edveis para pessoas com defici\u00eancia, e que a vota\u00e7\u00e3o n\u00e3o seja oferecida em todos os formatos acess\u00edveis.<br \/>\n53. A Comiss\u00e3o, recordando sua vis\u00e3o no comunicado n\u00ba 4\/2011 (Zsolt Bujdoso e cinco outros v. Hungria) de que as restri\u00e7\u00f5es legislativas sobre o direito de voto das pessoas com defici\u00eancia, cuja capacidade legal foi restringido nos termos da tutela viola o artigo 29 da Conven\u00e7\u00e3o, insta o Estado a remover as restri\u00e7\u00f5es legais e imediatamente restaurar o direito de voto para as pessoas privadas de capacidade jur\u00eddica atrav\u00e9s de interdi\u00e7\u00e3o. O Comit\u00ea tamb\u00e9m recomenda que o Estado-parte\u00a0 aumentar os seus esfor\u00e7os para assegurar que a vota\u00e7\u00e3o procedimentos, instala\u00e7\u00f5es e materiais sejam totalmente acess\u00edveis para pessoas com defici\u00eancia.<\/p>\n<p>Participa\u00e7\u00e3o na vida cultural, recrea\u00e7\u00e3o, lazer e esporte (30 art.)<br \/>\n54. O Comit\u00ea est\u00e1 preocupado que o Estado n\u00e3o tenha ratificado o Tratado de Marrakesh para facilitar o acesso \u00e0s obras publicadas por pessoas cegas, deficientes visuais, ou caso contr\u00e1rio imprima pessoas com defici\u00eancia, o que permitiria pessoas que s\u00e3o cegos, deficientes visuais ou impedidos de ler impressos para acessar trabalhos publicados. Tamb\u00e9m est\u00e1 preocupado que as \u00e1reas tur\u00edsticas e instala\u00e7\u00f5es n\u00e3o s\u00e3o totalmente acess\u00edveis para pessoas com defici\u00eancia.<br \/>\n55. O Comit\u00ea recomenda que o Estado Parte ratifique o Tratado de Marrakesh. Recomenda ainda que tome medidas apropriadas para assegurar que as bibliotecas sejam acess\u00edveis a todas as pessoas com defici\u00eancia, incluindo pessoas com defici\u00eancias cognitivas ou psico-sociais e aquelas que s\u00e3o surdas-cegas. Recomenda ainda a intensifica\u00e7\u00e3o de seus esfor\u00e7os para fazer o turismo no Brasil totalmente acess\u00edvel.<\/p>\n<p>C. Obriga\u00e7\u00f5es espec\u00edficas (arts. 31-33)<\/p>\n<p>Estat\u00edsticas e coleta de dados (art. 31)<br \/>\n56. O Comit\u00ea est\u00e1 preocupado que o Estado n\u00e3o colete sistematicamente dados desagregados em todos os setores de acordo com sexo, idade, defici\u00eancia, povos ind\u00edgenas e localiza\u00e7\u00e3o geogr\u00e1fica.<br \/>\n57. O Comit\u00ea recomenda que o Estado Parte facilite a coleta sistem\u00e1tica, an\u00e1lise e dissemina\u00e7\u00e3o de dados desagregados em todos os setores, incluindo sa\u00fade, educa\u00e7\u00e3o, emprego, participa\u00e7\u00e3o pol\u00edtica, acesso \u00e0 justi\u00e7a, prote\u00e7\u00e3o social, viol\u00eancia e invalidez e de acordo com outras categorias listadas acima, altere as perguntas do censo, em estreita coopera\u00e7\u00e3o com as organiza\u00e7\u00f5es de pessoas com defici\u00eancia, para refletir com precis\u00e3o a popula\u00e7\u00e3o.<\/p>\n<p>Coopera\u00e7\u00e3o internacional (art. 32)<br \/>\n58. O Comit\u00ea encoraja o Estado parte a integrar a perspectiva baseada em direitos das pessoas com defici\u00eancia, em conformidade com as disposi\u00e7\u00f5es da Conven\u00e7\u00e3o, em todos os esfor\u00e7os para cumprir a Agenda de Desenvolvimento p\u00f3s-2015 , incluindo a garantia de participa\u00e7\u00e3o das organiza\u00e7\u00f5es representativas das pessoas com defici\u00eancia em acompanhamento da sua execu\u00e7\u00e3o.<br \/>\nImplementa\u00e7\u00e3o e acompanhamento nacional (art. 33)<br \/>\n59. O Comit\u00ea est\u00e1 preocupado que o Conselho Nacional para a Protec\u00e7\u00e3o dos Direitos de Pessoas com Defici\u00eancia (CONADE) n\u00e3o constitui um mecanismo de controlo independente em conformidade com os Princ\u00edpios de Paris.<br \/>\n60. O Comit\u00ea recomenda que o Estado Parte estabelecer um mecanismo independente em conformidade com os Princ\u00edpios de Paris com os recursos necess\u00e1rios para promover, proteger e monitorar a implementa\u00e7\u00e3o da Conven\u00e7\u00e3o, assegurando a plena participa\u00e7\u00e3o das pessoas com defici\u00eancia e suas organiza\u00e7\u00f5es representativas mencionados neste documento.<br \/>\nAcompanhamento e divulga\u00e7\u00e3o<br \/>\n61. O Comit\u00ea solicita que o Estado Parte, no prazo de 12 meses e de acordo com o artigo 35, par\u00e1grafo 2, da Conven\u00e7\u00e3o, forneceremos informa\u00e7\u00f5es por escrito sobre as medidas tomadas para implementar as recomenda\u00e7\u00f5es da Comiss\u00e3o, conforme estabelecido nos par\u00e1grafos 25 e 35 (a) acima.<br \/>\n62. O Comit\u00ea solicita ao Estado Parte para implementar as recomenda\u00e7\u00f5es do Comit\u00e9 como contidos nas observa\u00e7\u00f5es finais. Ele recomenda que o Estado Parte transmitir as observa\u00e7\u00f5es finais para considera\u00e7\u00e3o e a\u00e7\u00e3o para os membros do Governo e do Congresso Nacional, funcion\u00e1rios de minist\u00e9rios relevantes, autoridades locais, membros de grupos profissionais relevantes, como a educa\u00e7\u00e3o, assist\u00eancia m\u00e9dica e profissionais da \u00e1rea jur\u00eddica, bem como a meios de comunica\u00e7\u00e3o, utilizando estrat\u00e9gias de comunica\u00e7\u00e3o social modernos.<br \/>\n63. O Comit\u00ea solicita ao Estado Parte que dissemine estas observa\u00e7\u00f5es finais amplamente, inclusive das organiza\u00e7\u00f5es n\u00e3o governamentais e organiza\u00e7\u00f5es representativas das pessoas com defici\u00eancia, bem como para pessoas com eles mesmos e os membros das suas fam\u00edlias, defici\u00eancia em l\u00ednguas nacionais e das minorias, incluindo linguagem de sinais, e em formatos acess\u00edveis, e disponibiliz\u00e1-los no site do governo sobre os direitos humanos.<br \/>\nPr\u00f3ximo relat\u00f3rio<br \/>\n65. It welcomes the establishment of councils on the rights of persons with disabilities at the municipal and state levels as well as at the Federal District, the adoption of several measures to improve accessibility in the different areas of the Convention such as the BB Accessibility campaign to facilitate access to assistive technologies, the establishment of the Ministerial Committee of Technical Aid, and the legal provisions to implement accessibility to the governmental websites, radio and the TV, and the provision of cash benefits for persons with disabilities by the Social Security System.<br \/>\n5.\u00a0\u00a0 \u00a0The Committee also commends the State party for its membership of the Washington Group on Disability Statistics, and its international cooperation agenda to enhance the exercise of rights of persons with disabilities in Portuguese speaking countries.<br \/>\nIII.\u00a0\u00a0 \u00a0Principal areas of concern and recommendations<br \/>\nA.\u00a0\u00a0 \u00a0General principles and obligations (arts. 1\u20134)<br \/>\n6.\u00a0\u00a0 \u00a0The Committee is concerned at the lack of a coherent and comprehensive disability strategy to implement the human rights model of disability established in the Convention and harmonize the State party\u2019s legislation, policies and programmes.<br \/>\n7.\u00a0\u00a0 \u00a0The Committee recommends the State party to develop a disability strategy to implement the human rights model of disability. The Committee further recommends that, in consultation with organizations of persons with disabilities, the State party initiates a systematic review of existing legislation, policies and programmes and where necessary brings them into line with the Convention. This should include a review of any legislation, policies or programmes upon which the rights of persons with disabilities are restricted or denied on the basis of impairment, or where services or benefits to persons with disabilities lead to their segregation or exclusion.<br \/>\n8.\u00a0\u00a0 \u00a0 The Committee is concerned that the Statute of Persons with Disabilities (Lei Brasileira de Inclus\u00e3o da Pessoa com Defici\u00eancia) does not meet all of the State party\u2019s obligations under the Convention.<br \/>\n9.\u00a0\u00a0 \u00a0The Committee urges the State party to take immediate steps to bring the Statute of Persons with Disabilities (Lei Brasileira de Inclus\u00e3o da Pessoa com Defici\u00eancia) into full alignment with the Convention before it enters into force, in consultation with organizations of persons with disabilities.<br \/>\n10.\u00a0\u00a0 \u00a0The Committee is concerned at the lack of mechanisms in place for the participation of persons with disabilities, through their representative organizations, in decision-making processes relating to the implementation of the Convention.<br \/>\n11.\u00a0\u00a0 \u00a0The Committee recommends the adoption of a consultative mechanism for systematic consultations with persons with disabilities, through their representative organizations, on policies, programmes and legislation relating to the implementation of the Convention.\u00a0 The Committee also recommends the State party to promptly implement the results of all national conferences on the rights of persons with disabilities, including the proposals from the \u201cIII National Conference on the Rights of Persons with Disabilities\u201d (CRPD\/C\/BRA\/Q\/1\/Add.1 para. 11).<br \/>\nB.\u00a0\u00a0 \u00a0Specific rights (arts. 5\u201330)<br \/>\nEquality and non-discrimination (art. 5)<br \/>\n12.\u00a0\u00a0 \u00a0The Committee is concerned at the lack of measures to address discrimination against indigenous and Afro-descendant persons with disabilities. In particular, it is concerned about the isolation of indigenous communities that place persons with disabilities in extreme exclusion conditions.<br \/>\n13.\u00a0\u00a0 \u00a0The Committee recommends the State party to implement legislation, inter-sectorial policies and programmes to address the multiple forms of discrimination against indigenous and Afro-descendant persons with disabilities, in particular, to prevent persons with disabilities living in isolated indigenous communities or remote areas from being excluded.<br \/>\nWomen with disabilities (art. 6)<br \/>\n14.\u00a0\u00a0 \u00a0The Committee is concerned that measures taken by the State party for preventing violence against women and girls, such as the Maria da Penha law (Law No. 11340\/2006) and the Women\u2019s Assistance Hotline \u2013 Dial 180, are not effective in combatting violence against women and girls with disabilities, and are not fully accessible to deaf and other women and girls with disabilities.<br \/>\n15.\u00a0\u00a0 \u00a0The Committee recommends the State party to take immediate action to adopt a due diligence framework to ensure that its laws, policies and programmes targeting violence against women, including institutionalized women are accessible and effective in preventing and redressing violence against women and girls with disabilities, and include specific measures, targets and indicators.<br \/>\n16.\u00a0\u00a0 \u00a0The Committee is also concerned that the State party does not have a strategy to ensure the full development, advancement and empowerment of women with disabilities in accordance with article 6, paragraph 2 of the Convention.<br \/>\n17.\u00a0\u00a0 \u00a0The Committee recommends that, in consultation with women with disabilities and their representative organizations, the State party implement a strategy to promote each of the three elements of article 6, paragraph 2 of the Convention.<br \/>\nChildren with disabilities (art. 7)<br \/>\n18.\u00a0\u00a0 \u00a0The Committee is concerned that children with disabilities are not systematically involved in decisions that affect their lives and do not have the opportunity to express their opinion in matters that affect them directly.<br \/>\n19.\u00a0\u00a0 \u00a0The Committee recommends the State party to adopt safeguards to ensure consultation of girls and boys with disabilities and their representative organizations in all decisions that affect their lives.<br \/>\nAwareness-raising (art. 8)<br \/>\n20.\u00a0\u00a0 \u00a0The Committee is concerned at the lack of strategies to specifically promote the contents of the Convention and the human rights model of disability to the general public, public officials and private actors.<br \/>\n21.\u00a0\u00a0 \u00a0The Committee recommends that the State party, in cooperation with organizations of persons with disabilities, undertake public awareness campaigns to reinforce the positive image of persons with disabilities as holders of all of the human rights enshrined in the Convention. The Committee also recommends the State party to provide training on the rights recognized in the Convention to all public authorities, and public and private professionals working with persons with disabilities. It also recommends to provide information on the Convention to persons with disabilities in special, indigenous persons with disabilities and their families.<br \/>\nAccessibility (art.9)<br \/>\n22.\u00a0\u00a0 \u00a0The Committee notes with concern that accessibility of built environment, transport, information and communication and services open to the public is not fully achieved, especially in remote and rural areas.<br \/>\n23.\u00a0\u00a0 \u00a0The Committee recommends to the State Party to take efficient measures to ensure accessibility of built environment, transport, information and communication and services open to the public, in line with the Committee\u2019s general comment No. 2 (2014), on accessibility, in rural and remote areas, including by full implementation of the existing legislation, including public procurement, and policies, efficient monitoring and sanctioning all that fail to comply fully with accessibility standards.<br \/>\nEqual recognition before the law (art. 12)<br \/>\n24.\u00a0\u00a0 \u00a0The Committee is concerned that\u00a0 some of the State party\u2019s legislation still provides for substituted decision-making in some circumstances.\u00a0 This is contrary to article 12 of the Convention as elaborated in the Committee\u2019s general comment No. 1 (2014) on equal recognition before the law. The Committee is also concerned that supported decision-making procedures require judicial approval and do not give primacy to the autonomy, will and preferences of persons with disabilities.<br \/>\n25.\u00a0\u00a0 \u00a0The Committee urges the State party to withdraw all legal provisions that perpetuate the system of substituted decision-making. It also recommends that, in consultation with organizations of persons with disabilities and other service providers, the State party take tangible steps to replace the system of substitute decision-making with a supported decision-making model that upholds the autonomy, will and preferences of persons with disabilities in full conformity with article 12 of the Convention. It further recommends that all persons with disabilities currently under guardianship be kept duly informed about the new legal scheme and the exercise of the right to supported decision-making should be guaranteed in all cases.<br \/>\nAccess to justice (art. 13)<br \/>\n26.\u00a0\u00a0 \u00a0The Committee is concerned at the inaccessibility of judicial facilities. It is also concerned about the lack of measures to ensure procedural gender-sensitive and age-appropriate accommodations related to persons with disabilities.<br \/>\n27.\u00a0\u00a0 \u00a0The Committee recommends the State party to introduce a national plan to ensure accessibility of judicial facilities. It also recommends to take measures to ensure that legal proceedings include gender-sensitive and age-appropriate accommodations for persons with disabilities. Furthermore, the Committee recommends the introduction of effective training of personnel in the justice, police and prison systems on the rights enshrined in the Convention.<br \/>\nLiberty and security of the person and freedom from torture or cruel, inhuman or degrading treatment or punishment (arts. 14 and 15)<br \/>\n28.\u00a0\u00a0 \u00a0The Committee is concerned at reports of the arbitrary deprivation of liberty and involuntary treatment of persons with disabilities on the basis of impairment, including situations where it is assumed that persons with disabilities are dangerous to themselves or others on the basis of a diagnosis of impairment.<br \/>\n29.\u00a0\u00a0 \u00a0The Committee recommends the State party to take measures, including the repeal of relevant legal provisions, to abolish the practice of involuntary commitment or hospitalization prohibit forced medical treatment, in particular, psychiatric treatments, on the basis of impairment and provide sufficient community-based alternatives.<br \/>\n30.\u00a0\u00a0 \u00a0The Committee is concerned that persons with disabilities who are deemed not liable for the commission of a crime on the basis of impairment may be subject to security measures, including indefinite detention. The Committee is also concerned about arbitrary detentions that may amount to inhuman and degrading treatment or torture. It is further concerned about the situation of persons with disabilities deprived of their liberty in prisons and other places of detention, which are severely overcrowded and where psychical and psychological ill-treatment of inmates becomes a norm, as stated by the UN Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment at the end of his official visit to Brazil in August 2015.<br \/>\n31.\u00a0\u00a0 \u00a0The Committee recommends the State party to:<br \/>\n(a)\u00a0\u00a0 \u00a0Abolish security measures that involve the arbitrary detention of persons with disabilities on the basis of impairment and implement alternative measures that are consistent with articles 14 and 19 of the Convention; and<br \/>\n(b)\u00a0\u00a0 \u00a0Ensure that penitentiary facilities are accessible and provide reasonable accommodation for persons with disabilities.<br \/>\nFreedom from exploitation, violence and abuse (art. 16)<br \/>\n32.\u00a0\u00a0 \u00a0The Committee is concerned at the lack of dedicated mechanisms for identifying, investigating and prosecuting instances of exploitation, violence and abuse against persons with disabilities. The Committee also regrets the lack of disaggregated data on reports, investigations and prosecutions of abuse, exploitation and violence against women, men, girls and boys with disabilities.<br \/>\n33.\u00a0\u00a0 \u00a0The Committee recommends the State party to ensure the availability of accessible, effective and independent monitoring of facilities and programmes designed to serve persons with disabilities, and complaint mechanisms in alignment with article 16(3) to ensure that authorities can identify, investigate and prosecute all cases of violence against persons with disabilities. It also recommends to ensure that the Public Ministry and the attorney offices for persons with disabilities investigate cases related to violence and exploitation of persons with disabilities by allocating the necessary human, technical and financial resources.\u00a0 The Committee recommends that the State party collect disaggregated data and statistics on reports by persons with disabilities of abuse, exploitation and violence, and their outcomes.<br \/>\nProtecting the integrity of the person (art. 17)<br \/>\n34.\u00a0\u00a0 \u00a0The Committee is deeply concerned that children and adults with disabilities whose legal capacity is restricted through interdiction can be sterilized without their free and informed consent, pursuant to Law No. 9263\/1996. It is also concerned that the Statute of Persons with Disabilities (Lei Brasileira de Inclus\u00e3o da Pessoa com Defici\u00eancia), authorizes surgical treatment on persons with disabilities under curatela, in absence of free, prior and informed consent on an unequal basis with others.<br \/>\n35.\u00a0\u00a0 \u00a0The Committee recommends the State party take measures to:<br \/>\n(a)\u00a0\u00a0 \u00a0immediately revise Law No. 9263\/1996 and explicitly and unconditionally prohibit the sterilization of persons with disabilities in the absence of their individual prior, fully informed and free consent;<br \/>\n(b)\u00a0\u00a0 \u00a0ensure that persons with disabilities are provided with support to make informed choices and decisions regarding medical procedures and interventions; and<br \/>\n(c)\u00a0\u00a0 \u00a0conduct campaigns to raise awareness among families, guardians, medical professionals and managers of institutions of the rights of persons with disabilities, particularly women and girls with disabilities, under article 17 of the Convention.<br \/>\nLiving independently and being included in the community (art. 19)<br \/>\n36.\u00a0\u00a0 \u00a0The Committee is concerned at the lack of access to support services and allowances, especially personal assistance services, aimed at enabling persons with disabilities to live independently and be included in the community. The Committee is also concerned that the State party does not have a comprehensive strategy to replace institutionalization with community-based living for persons with disabilities.<br \/>\n37.\u00a0\u00a0 \u00a0The Committee recommends the State party to establish a framework providing for legal entitlement to personal assistance services to enable persons with disabilities to live independently in the community. The Committee also recommends that, in consultation with organizations of persons with disabilities, the State party develop and implement an effective de-institutionalization and community-based living strategy with clear time frames and benchmarks.<br \/>\nFreedom of expression and opinion, and access to information (art. 21)<br \/>\n38.\u00a0\u00a0 \u00a0The Committee is concerned that information intended for the general public, including official pronouncements and political campaigns, is still not fully available in accessible formats, such as Braille, Brazilian sign language (LIBRAS), and other accessible modes, means and forms of communication, including easy to read\u00a0 format.<br \/>\n39.\u00a0\u00a0 \u00a0The Committee recommends the State party to provide the necessary resources and training to ensure that all information intended for the general public is available in a timely manner in accessible formats and technologies.<br \/>\nRespect for home and family life (art. 23)<br \/>\n40.\u00a0\u00a0 \u00a0The Committee is concerned that persons with disabilities are separated from their children on the basis of impairment.<br \/>\n41.\u00a0\u00a0 \u00a0The Committee recommends the State party to take legal action to explicitly prohibit the removal of children on the basis of their parents\u2019 impairment, including where the parent is subject to interdiction.<br \/>\n42.\u00a0\u00a0 \u00a0The Committee is concerned at the lack of disaggregated data on the number of families of children with disabilities who have access to community-based supports, such as the Specialized Social Assistance Reference Centers (Centro de Refer\u00eancia Especializado da Assist\u00eancia Social \u2013 CREAS).<br \/>\n43.\u00a0\u00a0 \u00a0The Committee recommends the State party to collect and report disaggregated data on the availability of community-based supports for families of children with disabilities, and the number of families who access those services.<br \/>\nEducation (art. 24)<br \/>\n44.\u00a0\u00a0 \u00a0The Committee is concerned that children with disabilities are refused admission to schools, or are charged extra fees. Furthermore, the Committee is concerned about a lack of reasonable accommodation and accessible school environments in the mainstream education system.<br \/>\n45.\u00a0\u00a0 \u00a0The Committee recommends the State party to strengthen its efforts with adequate budgetary allocations to consolidate an inclusive quality education system. It also recommends to implement a mechanism to prohibit, monitor and sanction disability-based discrimination in the public and private education systems, and to provide reasonable accommodation and accessibility in all educational facilities.<br \/>\nHealth (art. 25)<br \/>\n46.\u00a0\u00a0 \u00a0The Committee is concerned that mainstream health services are not accessible to persons with disabilities. The Committee is also concerned at the lack of health professionals who have adequate training to provide inclusive health care and meet the specific needs of persons with disabilities.<br \/>\n47.\u00a0\u00a0 \u00a0The Committee recommends the State party to adopt plans and allocate resources to ensure that mainstream health services, including sexual and reproductive health services and information, are accessible to persons with disabilities. It also recommends the State party to ensure that health professionals in mainstream health services receive training on the rights enshrined in the Convention.<br \/>\nWork and employment (art. 27)<br \/>\n48.\u00a0\u00a0 \u00a0The Committee is concerned at discrimination against persons with disabilities in the realm of employment, especially women with disabilities, and continue reliance on sheltered workshops. It is also concerned about the low levels of compliance with the quota system applying to private businesses with 100 or more employees.<br \/>\n49.\u00a0\u00a0 \u00a0The Committee recommends that, in consultation with organizations representing persons with disabilities, the State party develop and implement a coordinated strategy to increase employment of persons with disabilities in the open labour market, including specific measures for women with disabilities. It is further recommended to take immediate action to create possibilities for transition from segregated employment to the open labour market.<br \/>\nAdequate standard of living and social protection (art. 28)<br \/>\n50.\u00a0\u00a0 \u00a0The Committee is concerned that many persons with disabilities are living in poverty and have no access to resources for adequate standard of living; it is particularly concerned about persons with disabilities living in isolated indigenous communities, rural and remote areas who are exposed to exclusion and extreme poverty conditions.<br \/>\n51.\u00a0\u00a0 \u00a0The Committee recommends the State party to review the qualification requirements for social protection to ensure access for persons with disabilities who are living in poverty and enable them to cover expenses related to impairment, giving particular attention to those living in isolated indigenous communities, rural and remote areas. Participation in political and public life (art. 29)<br \/>\n52.\u00a0\u00a0 \u00a0The Committee is concerned that persons with disabilities under interdiction are discriminated against in relation to their right to vote. The Committee is also concerned that many polling places are not accessible to persons with disabilities, and that voting information is not provided in all accessible formats.<br \/>\n53.\u00a0\u00a0 \u00a0The Committee, recalling its views in communication No. 4\/2011 (Zsolt Bujdos\u00f3 and five others v. Hungary) that legislative restrictions on the right to vote of persons with disabilities whose legal capacity was restricted pursuant to guardianship breached article 29 of the Convention, urges the State party to remove legal restrictions and immediately restore the right to vote for persons deprived of legal capacity through interdiction. The Committee also recommends the State party to increase its efforts to ensure that voting procedures, facilities and materials are fully accessible to persons with disabilities.<br \/>\nParticipation in cultural life, recreation, leisure and sport (art. 30)<br \/>\n54.\u00a0\u00a0 \u00a0The Committee is concerned that the State party has not ratified the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired, or Otherwise Print Disabled, which would enable persons who are blind, visually impaired or otherwise print disabled to access published works. It is also concerned that tourist areas and facilities are not fully accessible to persons with disabilities.<br \/>\n55.\u00a0\u00a0 \u00a0The Committee recommends that the State party ratify the Marrakesh Treaty. It further recommends to take appropriate measures to ensure that libraries are accessible to all persons with disabilities, including persons with cognitive or psycho-social impairments and those who are deaf-blind. It further recommends to step up its efforts to make tourism in Brazil fully accessible.<br \/>\nC.\u00a0\u00a0 \u00a0Specific obligations (arts. 31\u201333)<br \/>\nStatistics and data collection (art. 31)<br \/>\n56.\u00a0\u00a0 \u00a0The Committee is concerned that the State party does not systematically collect disaggregated data across all sectors according to sex, age, disability, indigenous peoples and geographic location.<br \/>\n57.\u00a0\u00a0 \u00a0The Committee recommends that the State party systematically facilitate the collection, analysis and dissemination of disaggregated data across all sectors including health, education, employment, political participation, access to justice, social protection, and violence by disability and according to other categories listed above, and amend the census questions, in close cooperation with organisations of persons with disabilities, to accurately reflect the population.<br \/>\nInternational cooperation (art. 32)<br \/>\n58.\u00a0\u00a0 \u00a0The Committee encourages the State party to integrate a disability rights-based perspective, in accordance with the provisions of the Convention, in all efforts aimed at achieving the post-2015 Development Agenda, including ensuring participation of representative organizations of persons with disabilities in monitoring its implementation.<br \/>\nNational implementation and monitoring (art. 33)<br \/>\n59.\u00a0\u00a0 \u00a0The Committee is concerned that the National Council for the Protection of the Rights of People with Disabilities (CONADE) does not constitute an independent monitoring mechanism in accordance with the Paris Principles.<br \/>\n60.\u00a0\u00a0 \u00a0The Committee recommends that the State party establish an independent mechanism in line with the Paris Principles with the necessary resources to promote, protect and monitor implementation of the Convention, ensuring full participation of persons with disabilities and their representative organizations herein.<br \/>\nFollow-up and dissemination<br \/>\n61.\u00a0\u00a0 \u00a0The Committee requests that the State party, within 12 months and in accordance with article 35, paragraph 2 of the Convention, provide information in writing on the measures taken to implement the Committee\u2019s recommendations as set forth in paragraphs 25 and 35(a) above.<br \/>\n62.\u00a0\u00a0 \u00a0The Committee requests the State party to implement the recommendations of the Committee as contained in the present concluding observations. It recommends that the State party transmit the concluding observations for consideration and action to members of the Government and National Congress, officials in relevant Ministries, local authorities, members of relevant professional groups, such as education, medical and legal professionals, as well as the media, using modern social communication strategies.<br \/>\n63.\u00a0\u00a0 \u00a0The Committee strongly encourages the State party to involve civil society organizations, in particular disabled persons\u2019 organizations, in the preparation of its periodic report.<br \/>\n64.\u00a0\u00a0 \u00a0The Committee requests the State party to disseminate the present concluding observations widely, including to non-governmental organizations and representative organizations of persons with disabilities, as well as to persons with disabilities themselves and members of their families, in national and minority languages, including sign language, and in accessible formats, and to make them available on the government website on human rights.<br \/>\nNext report<br \/>\n65.\u00a0\u00a0 \u00a0The Committee requests the State party to submit its combined second, third and fourth periodic reports no later than 1 September 2022, and to include therein information on the implementation of the present concluding observations. The Committee invites the State party to consider submitting the above-mentioned reports under the Committee&#8217;s simplified reporting procedure, according to which the Committee prepares a list of issues at least one year prior to the date set for the report\/combined reports of a State party.
