\nNOTA DO CONADE AOS EXCELENT\u00cdSSIMOS SENHORES CONGRESSISTAS<\/span><\/span><\/strong><\/p>\n

CONVEN\u00c7\u00c3O SOBRE OS DIREITOS DAS PESSOAS COM DEFICI\u00caNCIA – RATIFICA\u00c7\u00c3O COM QUORUM QUALIFICADO \u2013 EQUIVAL\u00caNCIA CONSTITUCIONAL<\/span><\/span><\/strong><\/p>\n


\nA Emenda Constitucional n\u00ba 45, de 8 de dezembro de 2004 ao acrescentar o \u00a7 3\u00ba, ao artigo 5\u00ba da Constitui\u00e7\u00e3o, destaca o novo valor dos tratados e conven\u00e7\u00f5es internacionais sobre direitos humanos equivalendo-os \u00e0s emendas constitucionais, desde que aprovados, em cada Casa do Congresso Nacional, em dois turnos, por tr\u00eas quintos dos votos dos respectivos membros.<\/span><\/span><\/p>\n

Os direitos e garantias expressos na Constitui\u00e7\u00e3o n\u00e3o excluem outros previstos em tratados internacionais em que a Rep\u00fablica Federativa do Brasil seja parte (Art. 5\u00ba, \u00a7 2\u00ba). Portanto, os tratados e conven\u00e7\u00f5es internacionais, definitivamente analisados e aprovados pelo Congresso Nacional na forma de decreto legislativo, com ratifica\u00e7\u00e3o presidencial por meio de decreto, passam a integrar nosso sistema jur\u00eddico com efic\u00e1cia plena.<\/span><\/span><\/p>\n

A doutrina sustenta a primazia dos tratados internacionais de direitos humanos subscritos pelo Brasil, conferindo-lhes efic\u00e1cia de norma constitucional, e o reconhecimento de hierarquia especial e diferenciada, pois tratam da prote\u00e7\u00e3o de direitos inerentes a todos os seres humanos e, portanto, do valor da dignidade humana, elevado a princ\u00edpio fundamental pela Constitui\u00e7\u00e3o nos termos do Art. 1\u00ba, III.<\/span><\/span><\/p>\n

O Supremo Tribunal Federal relaciona a paridade normativa dos tratados e conven\u00e7\u00f5es com as leis ordin\u00e1rias, situando-os no mesmo plano, quanto \u00e0 efic\u00e1cia, ap\u00f3s sua formal incorpora\u00e7\u00e3o ao sistema, por interpreta\u00e7\u00e3o dos comandos constitucionais anteriores a 1988.<\/span><\/span><\/p>\n

Considerando tamb\u00e9m que as normas internacionais concorrem para a din\u00e2mica evolu\u00e7\u00e3o do princ\u00edpio da igualdade, elas t\u00eam a importante fun\u00e7\u00e3o de propor aos Estados Membros medidas para se promover a real igualdade \u2013 \u00e9 o que ocorre com a Conven\u00e7\u00e3o sobre Direitos da Pessoa com Defici\u00eancia e seu Protocolo Facultativo, mais novos documentos internacionais da ONU elaborados e aprovados dentro do sistema global de prote\u00e7\u00e3o aos direitos humanos.<\/span><\/span><\/p>\n

Encaminhada em 26 de setembro de 2007 ao Congresso Nacional para aprecia\u00e7\u00e3o, no \u00faltimo dia 13 de maio de 2008, data da Aboli\u00e7\u00e3o da Escravatura do Brasil, ocorreu a primeira vota\u00e7\u00e3o da MSC 711\/2007 na C\u00e2mara dos Deputados, cujo qu\u00f3rum de parlamentares computou 418 votos a favor da sua aprova\u00e7\u00e3o e 11 abstenc\u00f5es de votos, numero superior ao qu\u00f3rum constitucional m\u00ednimo estabelecido. <\/span><\/span><\/p>\n

Portanto, Senhores Congressistas, o CONADE agradece a expressiva vota\u00e7\u00e3o realizada no primeiro turno, e roga que no segundo turno da C\u00e2mara dos Deputados, o quorum qualificado tamb\u00e9m seja observado, assim como dever\u00e1 ser tamb\u00e9m no Senado Federal, conforme posto na Constitui\u00e7\u00e3o da Rep\u00fablica, para que, ao final, na implementa\u00e7\u00e3o e interpreta\u00e7\u00e3o dos direitos dispostos na Conven\u00e7\u00e3o sobre os Direitos das Pessoas com Defici\u00eancia e seu Protocolo Facultativo, seja dada a efic\u00e1cia de equival\u00eancia constitucional ao texto legal, elevando as pessoas com defici\u00eancia como p\u00fablico benefici\u00e1rio de direitos humanos, a um status jur\u00eddico diferenciado, como lhes foi dado direito, nos termos da Emenda Constitucional 45\/04.<\/span><\/span><\/p>\n
