{"id":35875,"date":"2026-07-07T11:12:29","date_gmt":"2026-07-07T11:12:29","guid":{"rendered":"https:\/\/inclusivenews.com.br\/?p=35875"},"modified":"2026-07-07T11:12:29","modified_gmt":"2026-07-07T11:12:29","slug":"35-anos-da-lei-de-cotas-o-que-avancou-e-o-que-ainda-precisa-mudar","status":"publish","type":"post","link":"https:\/\/inclusivenews.com.br\/?p=35875","title":{"rendered":"35 anos da Lei de Cotas: O que avan\u00e7ou e o que ainda precisa mudar"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">No <strong><a href=\"https:\/\/inclusivenews.com.br\/?cat=470\">Podcast Acessando Luc\u00edlia<\/a><\/strong>\u00a0desta ter\u00e7a-feira, 07\/07, vamos falar sobre uma das mais importantes conquistas da luta pela inclus\u00e3o no mercado de trabalho: os 35 anos da Lei de Cotas para Pessoas com Defici\u00eancia, institu\u00edda pela Lei n\u00ba 8.213, de 24 de julho de 1991.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Essa legisla\u00e7\u00e3o representa um marco na promo\u00e7\u00e3o da inclus\u00e3o profissional ao determinar que empresas com 100 ou mais empregados reservem de 2% a 5% de suas vagas para pessoas com defici\u00eancia e trabalhadores reabilitados pelo INSS, conforme o n\u00famero total de funcion\u00e1rios.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mais do que estabelecer um percentual de contrata\u00e7\u00e3o, a Lei de Cotas reconhece que a igualdade de oportunidades exige a\u00e7\u00f5es concretas para enfrentar as barreiras hist\u00f3ricas que sempre dificultaram o acesso das pessoas com defici\u00eancia ao mundo do trabalho.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ao longo dessas tr\u00eas d\u00e9cadas e meia, milhares de pessoas conquistaram autonomia, independ\u00eancia financeira e reconhecimento profissional gra\u00e7as \u00e0 legisla\u00e7\u00e3o. No entanto, o desafio ainda \u00e9 enorme. Dados do Minist\u00e9rio do Trabalho e Emprego mostram que quase metade das vagas destinadas \u00e0s pessoas com defici\u00eancia permanece sem preenchimento. Essa realidade nos leva a refletir que o problema n\u00e3o est\u00e1 na falta de profissionais qualificados, mas nas barreiras atitudinais, na aus\u00eancia de acessibilidade, na pouca oferta de qualifica\u00e7\u00e3o profissional e, muitas vezes, no descumprimento da pr\u00f3pria legisla\u00e7\u00e3o.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Al\u00e9m disso, a Lei Brasileira de Inclus\u00e3o (Lei n\u00ba 13.146\/2015) refor\u00e7ou esse compromisso ao proibir qualquer forma de discrimina\u00e7\u00e3o nas rela\u00e7\u00f5es de trabalho, garantir condi\u00e7\u00f5es de acessibilidade, promover adapta\u00e7\u00f5es razo\u00e1veis e fortalecer pol\u00edticas p\u00fablicas voltadas \u00e0 inclus\u00e3o, reafirmando que o trabalho \u00e9 um direito e um instrumento de cidadania.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Para conversar sobre os avan\u00e7os, os desafios e o futuro da inclus\u00e3o no mercado de trabalho, receberemos dois convidados que acompanham de perto essa trajet\u00f3ria e trar\u00e3o importantes reflex\u00f5es sobre o tema.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Jos\u00e9 Carlos do Carmo (Kal)<\/strong>, m\u00e9dico sanitarista, mestre em Sa\u00fade P\u00fablica e membro da equipe t\u00e9cnica do Centro de Refer\u00eancia Estadual em Sa\u00fade do Trabalhador de S\u00e3o Paulo (CEREST-SP). \u00c9 coordenador da C\u00e2mara Paulista para a Inclus\u00e3o da Pessoa com Defici\u00eancia no Mercado Formal de Trabalho e autor de livros e artigos nas \u00e1reas de sa\u00fade do trabalhador e inclus\u00e3o de pessoas com defici\u00eancia no mercado de trabalho.
