The Committee on the Rights of Persons with Disabilities meets for the
\nfirst time Edah Maina, Jia Yang, Mohammed Al-Tarawneh and Ron McCallum are among the 12 experts elected to the Committee on the Rights of Persons with Disabilities. The Committee, which meets for the first time from 23 to 27 February in Geneva, promotes and monitors the implementation of the Convention on the Rights of Persons with Disabilities.
\n“The disabled have suffered in ignorance and silence. They are the people
\nwithout any voice. Stigma and high levels of poverty have affected the
\nvoice of the parents and families who hide, chain, neglect and put in
\nconfinement their children or adults with disabilities. I want to be
\nthat voice of the voiceless and their families, to bring them justice
\nand a better life,” says Committee expert Edah Maina from Kenya.
\nThe inaugural session of the Committee will discuss the organization
\nof its future work, which involves the examination of periodic reports
\nfrom countries that have signed and ratified the Convention on the
\nRights of Persons with Disabilities. The Committee also deals with
\nindividual complaints under the Convention\u00b4s Optional Protocol.
\n“As you commence your work, the hope of all persons with
\ndisabilities around the world takes a huge leap forward. This beginning
\nof the practical application of the Convention in the lives of persons
\nwith disabilities is a historic milestone in the journey towards
\nachieving all human rights for all,” Deputy High Commissioner for Human
\nRights Kyung-wha Kang told the Committee when she opened its first
\nsession on 23 February.
\n“I am a person living with psychosocial disability.. .. My disability
\nhas given me a different meaning to life and encouraged me to give my
\ntime in service to humanity,” says Maina, who has been working in the
\nfield of intellectual, psychosocial and other disabilities for nine
\nyears.
\n“The challenges that I may face in the Committee of experts are
\nfirst and foremost bringing understanding of various disabilities in
\nvarious cultures of Africa. The perception of a person with disability
\nin developed countries may significantly differ from that of developing
\nnations,” she days.
\nThe Convention, adopted by the General Assembly in December 2006,
\nentered into force on 3 May 2008. It became the first new human rights
\ntreaty of the 21st Century.
\nHigh Commissioner for Human Rights Navi Pillay described the
\nConvention as “a paradigm shift”. It confirms “persons with
\ndisabilities as full and active members of society, with rights and
\nentitlements, rather than people dependent on good-will or charity or
\npeople to be approached from a medical perspective. ”
\nSo far “persons with disabilities have remained invisible in human
\nrights discourse and gained few benefits from the system crafted to
\npromote and protect the human rights of all,” she said after the
\nelection of the 12 Committee members last October.
\nIn addition to Maina, the Committee members include Ana Pel\u00e1ez
\nNarv\u00e1ez from Spain, Anma Ali Al Suweidi from Qatar, Cveto Ursic from
\nSlovenia, German Xavier Torres Correa from Ecuador, Gy\u00f6rgy K\u00f6nczei from
\nHungary, Jia Yang from China, Lotfi Ben Lallohom from Tunisia, Mar\u00eda
\nSoledad Cisternas Reyes from Chile, Mohammed Al-Tarawneh from Jordan,
\nMonsur Ahmed Choudhuri from Bangladesh and Ronald McCallum from
\nAustralia.
\nThere are more than half a billion persons with disabilities in the
\nworld today, or up to 10 percent of the population of each country. In
\ndeveloping countries, persons with disabilities are often particularly
\ndisadvantaged.
\nOnly 2 percent of children with disabilities in the developing world
\nreceive any formal education and globally, a disproportionate number of
\npersons with disabilities live in poverty.
\nJia Yang from China lost her vision completely at the age of 29. “I
\nbecame a bridge between the two worlds, the disabled and the
\nnon-disabled because I\u00b4ve been to both worlds long enough to know what
\neach is like and fully understand why the sighted can hardly imagine
\nhow a blind person feels.”
\nShe sees the economic and cultural differences between countries as a
\nmajor challenge for the Committee.
\n“Special attention must be paid to ensuring access to information,
\neducation and employment, especially education for woman and children
\nand better international co operation between developing and developed
\nnations,” Yang says.
\nMohammed Al-Tarawneh from Jordan points out that the effective
\nimplementation of the Convention hinges on the political will of
\ngovernments.
\n“I personally think that the major challenges in implementing the
\nConvention will be the political will of governmentsas there are many
\ncountries whichhave signed and ratified many international treaties but
\nwhichdidn\u00b4t comply or adhere to them fully,” he says.
\nAl-Tarawneh has been confined to a wheelchair since a car accident
\n32 years ago. As an engineer, he has worked to ensure physical access
\nfor disabled persons but he says, “I have come to understand that
\nremoving physical barriers needs to be coupled with an awareness
\nraising process towards [the] rights of people with disabilities and
\ncontinuous advocacyof these rights as well.”
\nRon McCallum from Australia wants to use his experience as a lawyer,
\neducator and advocate “to ensure that all human rights are inclusive of
\nand accessible to all persons with disabilities in line with the
\nprovisions and spirit of the Convention.”
\n“As a disabled person, I am acutely aware of the exclusion of
\npersons with disabilities from enjoying key human rights,” says
\nMcCallum, who has been blind all his life.
\n“The Committee will have to stand strong against attempts to limit the
\nscope of the Convention.
\n“I believe that a major challenge will be for the Committee to
\ndevelop high standards for the implementation of the Convention, while
\nat one and the same time recognizing the differences in the economic
\nand other capacities of states parties to implement aspects of the
\nConvention in a given period of time,” he adds.
\nFrom now on the Committee will meet twice a year in Geneva. So far
\n138 countries have signed the Convention and 49 have ratified it.
